"哈呅/哈盆/下盆(Habun/Hbun)聚落在過去歷經多次遷徙,最近一次搬遷發生在1963~1964年,從烏來區東南角毗鄰宜蘭縣的舊址,遷徙到現址。伴隨遷村,由政府主導了交換地:亦即將原居地的原住民保留地轉為林班地,再將現址的林班地轉為原住民保留地供族人使用。

但原居地的原住民保留地超過1000公頃,由林班地交換過來的土地僅有300多公頃,存在不小落差,是故透過本計畫釐清其中是否存在任何行政疏失或不正義的情事,並試圖研擬解決辦法。

經過史料重新蒐整與分析,本案確實存在不正義的事實。在對族人權利可能造成的損害上,除了在交換地當時,未讓族人清楚了解將損失的權利,交換地完成至今,在土地使用、生存環境上皆未能確保族人能維持原有的生存權與使用權,而是面對更加劣勢的處境。

在未依法行政的疑慮上,當年的「交換地」除了在既定的法規上未完備法定程序,部分處置亦有權責不一或於法無據的問題。

基於以上不正義情節,本計畫建議未來應循多個管道進行權利的回復,甚至不排除提送總統府原住民族歷史正義與轉型正義委員會處理。"

"The Habun/Hbun settlement moved for some times in their history. In the last movement during 1963~1964, they moved from the Southeast of Wulai, near Yilan County, to the current location. Along with the movement, the government conducted the “land-exchange”, i.e., transformed the Lands Preserved for Indigenous(LPI) in their old location into Public Forest Land(FL), and changed the FL nearby their new location into LPI for the settlement.

However, the area of the original LPI was above 1000 hectares, yet the exchanged one from FL is about 300 hectares, among which contains dramatical shortage. This investigation attempts to find out whether there exists any executive negligence or injustice, and then propose some possible solutions.

After re-collecting, organizing and analyzing of historical data, this case unquestionably exists some injustices: on the possible damages to the rights of the people of the settlement, the people didn’t exactly know how much they would lost during the land-exchange. Further, until now, the people do not have the rights to life and use as much as they originally had, especially on the land use and the environment they live in, which makes them live under worse situation.

On the suspicion of not ruling by law, the land-exchange didn’t fulfill all the processes required by the established regulations then. Further, some of processes involved the inconsistent between power and responsibility, or the lack of legal authority.

Based on the injustices listed above, we suggest some solutions about the right restoration, including submitting this case to the Indigenous Historical Justice and Transitional Justice Committee of Presidential Office."
