摘要
環顧眾多原住民族部落，在現行區域計畫法下缺乏因地制宜設計機制、土地分區管制不符合時宜及長期發展需求等諸多限制因素，其生活型態及傳統使用土地方式，長期處於現實需求與爭議不斷的現象。
105年(2016)5月1日行政院公告施行「國土計畫法」，且於105年6月17日發布『國土計畫法施行細則』，並明訂將於114年5月1日前，在先後完成全國國土計畫、縣市國土計畫與國土計畫功能分區劃設後，將全面取代現行區域計畫法。就現況而言，行政院107年4月30日核定公告「全國國土計畫」，台東縣國土計畫(草案)，於109年3月19日提送內政部審議，內政部109年7月21日國土計畫審議會大會通過，依國土計畫法實施時程期程，即須進行劃設國土功能分區分類，編定使用地。
因此，在尊重原民傳統文化的國土計畫下，本研究以臺東縣延平鄉原住民族部落(共計11個部落)為研究範圍，經相關圖資套繪後當中有4個部落在未來國土功能分區內，存有國土保育區、農業發展區第1類至第3類等之功能分區，因此，先試行調查族人土地使用需求慣習，可供未來國土計畫法下原住民族特定區域劃設及特定區域管制規則擬定參考，以解除現存不合理的土地使用管制，契合傳統文化慣習的土地使用方式，輔導部落提出土地規劃之需求，以符合在地族人未來發展需求並保存原民文化。
本研究另以臺東縣延平鄉11個核定部落為單元，依全國國土計畫、內政部及原住民族委員會所訂定之原住民族聚落範圍劃設原則及方式，逐一劃設各部落聚落範圍、建議劃設適當功能分區及建立圖資，聚落範圍及功能分區，經評估聚落條件，得劃設為農業發展地區第4類或城鄉發展地區第3類等。研究期間將劃設成果圖做為基準，於縣府109年辦理原住民族部落宣導說明會時，具體向部落族人完整說明未來國土計畫施行後對原住民族部落土地使用之影響，且研究成果提供臺東縣國土計畫實施參考。

ABSTRACT
Looking around many indigenous peoples, there is a lack of design mechanisms tailored to local conditions under the overall regional planning law, and many restrictive factors such as inconsistent land division control and long-term development needs. Their lifestyles and traditional land use methods have long been in real needs and controversies. phenomenon.
The Executive Yuan announced the implementation of the """"Law of Land and Land Planning"""" on May 1, 2016, and issued the """"Detailed Rules for the Implementation of the Land and Land Planning Act"""" on June 17, 2016, and it is clearly stated that it will be implemented before May 1, 2025. After the completion of the national territorial plan, the county and city territorial plan, and the functional zoning of the territorial plan, the current regional planning method will be fully replaced. As far as the current situation is concerned, the Executive Yuan approved the announcement on April 30, 2018, """"National Territorial Plan"""", Taitung County Territory Plan (draft), which was submitted to the Ministry of the Interior for deliberation on March 19, 2020, and the Ministry of Interior in July 2020. The National Land Planning Review Conference passed on the 21st, and according to the implementation time schedule of the National Land Planning Law, it is necessary to classify the national land function zoning and set the land for use.
Therefore, under the territorial plan that respects the traditional culture of the indigenous peoples, this study takes the indigenous tribes (a total of 11 tribes) in Yanping Township, Taitung County as the research scope. Among them, 4 tribes will be in the future functional zoning of the territory. After the map data set is drawn, there are functional areas such as the first to third categories of the land conservation area and the agricultural development area. Therefore, the first trial investigation of the land use demand habits of the tribes can be used for the specific areas of the aborigines under the future land planning law. Design and reference for the drafting of control rules for specific areas to remove the existing unreasonable land use control, conform to traditional cultural habitual land use methods, and counsel tribes to propose land planning needs to meet the future development needs of the local people and preserve the aboriginal culture .
This research also uses 11 approved tribes in Yanping Township, Taitung County as a unit, and delimits the tribal settlements one by one in accordance with the principles and methods for the delineation of the aboriginal settlements set by the National Land and Resources Plan, the Ministry of the Interior and the Indigenous Peoples Committee. , It is recommended to designate appropriate functional zoning and establish map data, settlement scope and functional zoning. After assessing settlement conditions, it can be classified as category 4 for agricultural development areas or category 3 for urban and rural development areas, etc. During the research period, the result map was used as a benchmark. When the county government handled the aboriginal tribe promotion and explanation meeting in 109, the tribal people were fully explained to the tribes on the impact of the future land plan on the land use of the aboriginal tribes, and The research results provide a reference for the implementation of Taitung County''s land plan.
