原住民族諮商同意權的執行評估:以南投縣魚池鄉為例

研究內容

本文以南投縣魚池鄉為例,探討有關諮商同意辦法附件內容,目的在了解政策執行的現況,以及利害關係人對諮商同意權中土地開發的看法與意見,進而作為後續政策調整之參考。研究過程以政策執行理論為基礎,透過深度訪談法,探討政策執行的過程與挑戰。再參考各領域專家學者對諮商同意權相關研究議題,思慮有關土地開發之現存問題。
研究對象及範圍,以參與過原住民議題之利害關係人擔任受訪者。研究架構以政策執行評估的理論為基礎,歸納出認知、規範、資源以及溝通四個面向。除此之外,諮商同意權本身涉及同意權的項目,增列第五個執行評估的項目面向。
研究發現基於質性分析的結果,首先,在認知方面,利害關係人認為透過不同開發案件積累與召開部落會議,多方面的意見參與及溝通,有助於部落及公部門間共識和回饋機制的建立。第二,在規範方面,針對土地資源進行利用,有營利行為項目或需要環評之開發,必須經過部落諮商同意。第三,在資源方面,諮商同意權的行使是藉由部落會議的召開,讓利害關係人間有一個溝通的平台。公部門應有系統的建立標準審查機制,協助部落並有效的整合政策資源及釐清政策目標。第四,在溝通方面,利害關係人對於諮商同意權的執行,著重於開發案的資訊透明與事前溝通,透過理性的溝通及瞭解,建立正式或非正式的溝通平台與機制。最後,在項目方面,利害關係人透過項目劃分與法規修正,訂定工程上限與明確的諮商同意項目,取得適當平衡,使部落、公部門及相關單位達成集體共識有所遵循。
為使政府能落實原住民族諮商同意權的行使,研究建議可從法規面合理界定開發項目內容、範圍及條件,並訂定法規適用時機及相應配套措施。強化諮商同意機權機制執行,建立管理組織審查、爭議排解機制、溝通窗口及管道,以示政府對原住民族的尊重及公正性。

With the case study in Yuchih-Township, Nantou County, this research is to study the attachment content regarding consultation and consent regulations aiming at understanding the current status of policy implementation and the views and opinions on land development of the stakeholders in the right of consultation and consent right, which may serve as the reference for adjustments of subsequent policies. The research process is based on the theory of policy implementation, and the process and challenges of policy implementation are examined through in-depth interviews before conferring with the relevant research agenda on consultation and consent by experts and scholars of different fields to articulate the existing problems in land development.
The research subject and scope have the stakeholders involved in the Indigenous Peoples’ agenda as the interviewees. The research is based on the theory policy implementation evaluation to induce four aspects of cognition, standard, resource, and communication. Furthermore, as the Right of Consultation and Consent involves the items of the Right of Consent, the fifth aspect of evaluation implementation was added.
As the research found the result of qualitative analysis, first of all, in terms of cognition, the stakeholders believed that through the accumulation of various development projects and the convening of tribal meetings, the participation and communication of opinions from many sides are instrumental towards the establishment of the consensus and feedback mechanism amongst the government department and the local tribes. Secondly, in terms of standard, any utilization of the land resources, profit-making projects, or development that requires environmental study shall be subject to consent from the tribes. Thirdly, in terms of resources, the Right of Consultation and Consent is exercised by convening the tribal meetings to afford the stakeholders a communication platform. The standard review mechanism systematically established by government authorities shall assist the tribes in effectively synergizing policy resources and clarifying policy objectives. Fourthly, in terms of communications, regarding exercising the Right of Consultation and Consent, the stakeholders place high premiums on information transparency and communication in advance of development projects and establish formal and informal communication platforms and mechanisms through rational communication and understanding. Lastly, in terms of items, the stakeholders shall set project cap and specific consultation and consent items, through item demarcation and regulation amendments, to achieve the appropriate balance to enable the tribes, government authorities, and the associated units to reach collective consensus for compliance by all parties.
For the government to ensure the exercising the Right of Indigenous Consultation and Consent, this research recommends to define development project content, scope, and conditions from the regulation standpoint while devising the applicable timing and the corresponding measures for the said regulations. Strengthen the implementation of the Right of Consultation and Consent mechanism, establish review process of the governing authorities, dispute resolution mechanism, and communication windows and channel, in honoring the respect and justice shown to the Indigenous Peoples by the government.
