臺灣原住民族文化權利的現況與展望— 臺灣原住民族文化影響評估機制初探

國際間原住民族權利在歷經諸多衝突與抗爭後,藉由條約、宣言之制定得以重新賦權。臺灣原住民族在此權利思潮下,亦透過多次原住民族運動爭取權利,然而至今原住民族文化權利遭受侵害的事件,依舊層出不窮。在此背景下,本研究試圖在現有法規、機制之架構下,延伸建立「原住民族文化影響評估機制」,透過機制之運作,嘗試將普遍的文化權與特殊權接合,轉譯、框定原住民族文化權利之意涵,並利用機制的特殊化設計,使原住民族特殊權利得以被正視、考量,而達到權利的普遍實踐,以作為強化與保障原住民族文化權利之可能方法。
本研究從「國內外一般性與原住民族文化權利之論述與臺灣實踐現況為何」、「國際間文化影響評估機制,特別是與原住民族相關之文化影響評估機制,其發展現況為何」、「臺灣原住民族文化影響評估之可能框架、流程和指標為何」,以及「此機制所能強化與保障之原住民族文化權利為何?及其可能性、侷限性以及未來展望為何」等四大問題展開研究。以文獻分析法掌握國內外文化影響評估背景與蒐集原住民族文化影響評估資料,並藉由深度訪談,汲取臺灣原住民族族人對於文化權利與評估機制的在地觀點,期使機制能更符合在地部落需求。
本研究透過治理技術面的框架、流程、指標之研擬,更細緻地針對原住民族文化「進行賦權」。本研究主要以三個論述取徑:「普遍權與特殊權的銜接」、「文化權利與多重權利的銜接」以及「文化權利與執行機制的銜接」,輔以人類學儀式觀點,檢視並分析本研究所建立之原住民族文化影響機制,並發現在三個論述取徑中,彼此都存在互為主體的雙向辯證關係,不但雙向擴充了特殊與普同文化權利概念上的詮釋,更推展至機制上的特殊與普同,拓展與強化了機制可能產生的影響與作用,用以保障與強化原住民族文化權利。最後,歸納機制之可能性與侷限性,並提出臺灣原住民族文化權利的未來展望。

The acquisition of the rights of indigenous peoples internationally has been re-empowered through the formulation of treaties and declarations after many struggles and conflicts. In response to this trend of rights, Taiwan’s indigenous peoples have also fought for rights through many indigenous peoples’ movements. However, the incidents of the indigenous peoples’ cultural rights that have been violated so far have continued to emerge. Under this background, this study attempts to extend the establishment of the “Cultural Impact Assessmentof Indigenous Peoples” within the framework of existing laws and mechanisms as a possible method to strengthen and protect the cultural rights of indigenous peoples.
This study starts with four questions: “What is the general status of domestic and foreign nationalities and the cultural status of indigenous peoples and the current status of Taiwan’s practice?”, “What is the current status of international cultural impact assessment, especially those related to indigenous peoples?”, “What are the possible frameworks, processes and indicators for the cultural impact assessment of indigenous peoples in Taiwan?” and “What are the cultural rights of indigenous peoples that can be strengthened and guaranteed by this mechanism? And what are its possibilities, limitations, and future prospects?” This study use literature analysis and in-depth interviews, draw on local views of Taiwan’s indigenous peoples on cultural rights and assessment mechanisms, and expect mechanisms can better meet the needs of local tribes.
In addition, this study takes three approaches: “the connection between universal rights and special rights”, “the connection between cultural rights and multiple rights” and “the connection between cultural rights and enforcement mechanisms”, supplemented by the anthropological ritual perspective as the theoretical framework for constructing this study. After establishing the culture impact assessment of indigenous peoples, we will take this approach to examine the mechanism, analyze why this mechanism can protect and strengthen the cultural rights of the indigenous peoples, summarize their feasibility and limitations, and finally propose the prospects of the cultural rights of the indigenous peoples.
